Maryland Statute of Limitations, Baltimore Creditors’ Rights

SELECT LAWS / STATUTE OF LIMITATIONS

The following is a summary of the general statute of limitations and select laws relevant to your collection issues in Maryland, the District of Columbia and Virginia:

 

 

MARYLAND:

  • Statute of Limitations
    • Contracts in Writing – three (3) years;
    • Open Accounts – three (3) years;
    • Contracts Under Seal – twelve (12) years;
    • Sale of Goods (UCC) – four (4) years;
    • MVA/Tort – three (3) years
  • Post-judgment Interest – 10% per annum from the date of judgment.
  • Attorney fee recovery only allowed if provided for in signed agreement between parties. The court must approve and fees must usually be supported by evidence of time spent as well as other factors.
  • Pre-Judgment Interest is allowed if provided for in a signed agreement between parties. Statutory interest of 6% per annum is permitted in cases with contractual obligation for a set sum due at fixed time.

 

DISTRICT OF COLUMBIA:

  • Statute of Limitations
    • Contracts in Writing – three (3) years;
    • Open Accounts – three (3) years;
    • Sale of Goods (UCC) – four (4) years;
    • MVA/Tort – three (3) years
  • Post-Judgment Interest – 2% per annum, or the prevailing rate as established by law (which is adjusted often) from the date of judgment.
  • Attorney fee recovery only allowed if provided for in signed agreement between parties.
  • Pre-Judgment Interest is allowed if provided for in signed agreement between parties.

 

VIRGINIA:

  • Statute of Limitations
    • Contracts in Writing – five (5) years;
    • Open Accounts – three (3) years;
    • Contracts Under Seal – twelve (12) years;
    • MVA/Tort
      • (Property damage) – five (5)  years;
      • (Bodily injury) – two (2)  years
  • Post-Judgment Interest – 6% per annum from the date of judgment.
  • Attorney fee recovery only allowed if provided for in signed agreement between parties.
  • Pre-Judgment Interest is allowed if provided for in signed agreement between the parties.
